These Terms of Service ("Terms") govern your access to and use of the DeputySec website and services (the "Service") provided by DeputySec ("DeputySec", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.

By accessing or using the Service, you confirm that you can form a binding contract and that you agree to these Terms and our Privacy Policy. If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.

DeputySec provides a security program management platform, including maturity assessments, risk and control tracking, and related tools. We may add, change, or remove features from time to time to improve the Service.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to notify us promptly of any unauthorised use of your account.

4. Acceptable use

You agree not to:

  • Use the Service in violation of any applicable law or regulation;
  • Attempt to gain unauthorised access to the Service, other accounts, or our systems;
  • Interfere with or disrupt the integrity or performance of the Service;
  • Reverse engineer or copy the Service except as permitted by law;
  • Upload malicious code or content that infringes the rights of others.

5. Your content

You retain ownership of the data and content you submit to the Service ("Customer Content"). You grant us a limited licence to host, process, and display Customer Content solely to provide and improve the Service. You are responsible for ensuring you have the rights to submit your Customer Content and that it complies with these Terms.

The Service, including its software, design, and content (excluding Customer Content), is owned by DeputySec and protected by intellectual property laws. Except for the rights expressly granted to you, we reserve all rights in the Service.

7. Fees

Some parts of the Service may be offered on a paid basis. Where fees apply, they will be described at the point of purchase. Unless stated otherwise, fees are non-refundable and you are responsible for any applicable taxes.

The Service may integrate with or link to third-party services. We are not responsible for third-party services, and your use of them is subject to their own terms and policies.

9. Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. DeputySec does not warrant that the Service will be uninterrupted, error-free, or secure. Assessment results and other outputs are provided for informational purposes and do not constitute professional, legal, or compliance advice.

10. Limitation of liability

To the maximum extent permitted by law, DeputySec will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the claim.

11. Indemnification

You agree to indemnify and hold DeputySec harmless from any claims, damages, or expenses arising from your use of the Service or your breach of these Terms.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will continue to apply.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing law

These Terms are governed by the laws applicable at DeputySec's principal place of business, without regard to conflict-of-law principles. Any disputes will be subject to the exclusive jurisdiction of the competent courts in that location.
